On August 9, 2023, President Biden issued an Executive Order introducing new outbound investment controls on investments by U.S. persons in China and Chinese-owned companies in the semiconductor, quantum computing, and artificial intelligence sectors. In addition, the U.S. Treasury issued an advance notice of proposed rulemaking seeking public comment on the key concepts and definitions relating to the implementation of the new regime. The public submitted comments at the end of September 2023.
Our panel discussion will provide insights on the topic and assess the challenges arising from the new controls for companies doing business connected to China.
SPEAKERS:
Adam Smith, an HLS alumnus, is a partner and co-chair of the International Trade practice group at Gibson Dunn. Adam is an international lawyer with substantial senior-level government experience and expertise in analyzing international economic, national security, political, and legal issues. Adam has worked at the Treasury Department and on the National Security Council Staff, where he, among other things, advised President Obama on his multilateral agenda and played a leading role in rolling back sanctions on Burma.
Giovanna Cinelli, a HBS alumna, is a partner and the International Trade and National Security practice lead at Morgan Lewis. She brings substantial experience counseling clients in the defense and high-technology sectors on a broad range of issues affecting national security and export controls, including complex export compliance matters, audits, cross-border due diligence, and export enforcement. Giovanna served as an expert witness on US export control laws and regulations and appeared on MSNBC with Chris Matthews and on Burden of Proof as an expert in international technology transfer, arms exports and related national security policy issues. Giovanna has also served as a Naval Reserve Intelligence Officer, a member of the Defense Trade Advisory Group, and a member of the Virginia/ DC District Export Council.
Nicholas Townsend, an HLS alumnus, is a Counsel in Arnold & Porter’s International Trade and National Security practices. Nicholas has extensive experience in export controls, trade sanctions, cybersecurity, privacy, and the aerospace industry. He also represents companies before the Committee on Foreign Investment in the United States (CFIUS). Nicholas was previously recognized for his leading role in Airbus settlement with U.S. State and Justice Departments which won the American Lawyer’s Industry Award that celebrated the “most impressive law firms and lawyers.”
MODERATOR:
Milana Karayanidi, an HLS alumna, is a Managing Associate in Dentons’ Federal Regulatory and Compliance practice. She solves sanctions and export controls issues in complex cross-border business environment and advises on foreign investment screening by CFIUS. Milana’s international education and experience provides an additional edge in her international practice.
